INFORMATION ON COLLECTION OF PERSONAL DATA

In this document we provide information about the collection of personal data when using our website. Personal data is any data which relates to you personally, e.g. name, address, e-mail addresses, or your behaviour as a user.

If you contact us by e-mail or using a contact form, we will store the data provided by you (your e-mail address, and if provided your name and phone number), so that we can respond to your query. We will delete any data gathered for this purpose when it is no longer necessary to store it, or we will restrict its use if legal retention obligations apply.

For situations in which we need to employ contracted service providers to deliver particular elements of what we offer, or for when we may wish to use your data for promotional purposes, we inform you in detail below about the particular procedures involved. We also state the set criteria for duration of storage.

YOUR RIGHTS: ACCESS, DELETION, RESTRICTION

At any time you may access, at no cost, personal data stored by us about you, as well as its origin, who has received it, and the purpose of the data collection and data processing. You also have the right to request the correction, restriction or deletion of your data. Excluded from this are data which we must retain due to legal requirements or which are necessary for proper business processes. So that data can be locked at any time, data may be stored in a blacklist file for control purposes. If data are not included in any legal archiving obligation, we will delete your data on request. If the archiving obligation applies, we will lock your data. For all questions and details on accessing, restricting or deletion of personal data please contact the Data Protection Officer using the contact details in this Privacy Policy or at the address given in “Legal Notice/Impressum”. You also have the right to complain about how we handle your personal data via the data protection supervisory authorities.

COLLECTION OF PERSONAL DATA WHEN VISITING OUR WEBSITE

For purely informative use of our website, that is when you do not register and do not otherwise provide us with information, we collect only the personal data which your browser provides to our server. If you choose to view our website, we collect the following data which are necessary technically for us to display the website and to ensure its stability and security. The legal basis is Article 6, section 1, sentence 1, point f of the General Data Protection Regulation (GDPR): IP address, date and time of the request, time difference to Greenwich Mean Time (GMT), content of the request (particular pages), access status/HTTP status code, quantity of data transferred, the referring website, browser, operating system and interface, and language and version of the browser software.

COOKIES

In addition to the data detailed above being collected, when you use our website cookies are saved on your computer. Cookies are small text files which are stored on your hard disk by your browser, and which are used by the site placing the cookie (in this case, us) to store certain information. Cookies cannot install any programs or transmit viruses to your computer. They serve only to make the internet experience more user-friendly and effective.

Use of cookies:

This website uses the following types of cookie, and their scope and functionality is explained below:

Transient cookies: see (a)

Persistent cookies: see (b).

a) Transient cookies are automatically deleted when you close your browser. Among them are session cookies. These save what is known as a “session ID” using which many separate requests from your browser during the same session can be grouped together. This means that we can recognise your computer if you return to our website. These session cookies are deleted when you log out or close your browser.

b) Persistent cookies are automatically deleted after a predetermined time which can be set on a cookie by cookie basis. You can delete these cookies at any time via the security settings of your browser.

c) You can configure your browser settings as you wish and e.g. prevent the acceptance of third party cookies, or all cookies. Please refer to the help functions of your browser for details of how to alter the relevant settings. We do advise that if you do this, you may not be able to use all functions of our website.

d) We place cookies so that we can identify you on subsequent visits, if you have an account with us. Otherwise you would have to log in afresh on every visit.

OTHER FUNCTIONS AND OFFERS ON OUR WEBSITE

Alongside purely informative use of our website we offer various services which you can use if you wish. To do this you need as a rule to provide additional personal data, which we will use to deliver this particular service, and for which the general data protection principles detailed above apply.

On occasion we use external service providers to process your data. These are carefully selected and contracted by us, operate under our instructions, and are checked regularly.

In addition we may pass your personal data to third parties, when promotions, competitions, contract completions or similar services are offered by us together with partners. You will receive further details about this when you provide your personal data, or see below in the descriptions of the particular offer.

Should our service provider or partner be based outside the European Economic Area (EEA), we will inform you of the implications of this in the offer description.

TRANSFER OF YOUR DATA TO OUR DELIVERY SERVICE PROVIDER

As part of our shipping process we transmit your data (name, address and if applicable e-mail address and/or mobile phone number) to our shipping partner DPD Deutschland GmbH, based on EU GDPR regulations Article 6 (1f). You can at any time refuse the transfer of optional information such as e-mail or mobile phone number either through us as part of the ordering process in our online shop after the order confirmation, or by e-mail to: [email protected] or by telephone on: 06151 – 860 330 or direct with DPD via: [email protected] or via the link on every package information message.

TRANSFER OF YOUR DATA TO OUR NEWSLETTER SERVICE PROVIDER

If you choose to receive the newsletter which we offer (on the website), we need an e-mail address from you, and information which allows us to check that you are the owner of the e-mail address provided, and that you consent to us sending the newsletters. To ensure we have informed consent to send newsletters we use what is known as a ‘double opt-in process’. This involves the potential recipient being added to a mailing list. Then the recipient receives a confirmation email with the option to legally confirm their subscription. Only when this confirmation is made does the e-mail address become active on the mailing list. We use this data exclusively to send the information and offers requested.

We use Newsletter2Go as our newsletter software. This means your data will be sent to Newsletter2Go GmbH. Newsletter2Go is forbidden from selling your data or using it for any other purpose than sending the newsletters. Newsletter2Go is a German, certified supplier which was selected for its compliance with the EU GDPR and German data protection regulations.

You can find further details here: https://www.newsletter2go.de/i...

You can at any time cancel your consent to the storage of your data, your e-mail address, and its use for the sending of newsletters, using the ‘Unsubscribe’ link in each newsletter.

Ongoing technical advances underpin these data protection measures and for this reason we request that you review our data protection measures at regular intervals by viewing our Privacy Policy.

REFUSAL OR REVOCATION OF CONSENT TO PROCESS YOUR DATA

If you have given your consent for the processing of your data, you can revoke this at any time. Such a revocation will affect the lawfulness of processing your personal data, once you have communicated this to us.

Where we base the processing of your personal data on the balance of legitimate interests, you can lodge your refusal of this processing. This applies when the processing is not specifically necessary for the fulfilment of a contract with you, as we describe below in the descriptions of the various functions. If you lodge such an objection, please provide us with the grounds that we should not process your personal data using our usual procedures. Should there be legitimate grounds for objection, we will investigate the situation and either terminate or change the data processing, or provide you with compelling legitimate grounds for continuing the processing.

Naturally, you can revoke your consent to processing of your personal data for advertising and data analysis purposes at any time. You can inform us of your objection to advertising use using the contact details given above.

USE OF GOOGLE ANALYTICS

This website uses Google Analytics, a web analysis service from Google Inc. (“Google”). Google Analytics uses “cookies”, text files which are stored on your computer and which allow your use of the website to be analysed. The information about your use of this website which is created by the cookie is generally transmitted to, and stored on, a Google server in the USA. If IP anonymisation is activated on this website, your IP address will, however, be shortened by Google within the member states of the European Union or in other contracting states to the agreement on the European Economic Area. Only in exceptional circumstances will the full IP address be transmitted to a Google server in the USA and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of the website, so as to compile reports on website activity and to perform other services associated with the use of the website and with the internet use of the website operator.

The IP address transmitted from your browser within the framework of Google Analytics is not combined by Google with other data.

You can prevent cookies from being stored by setting your browser software to do this; we draw your attention to the fact, however, that you may not be able to use all the functions of this website to their full extent if you do this. You can furthermore prevent the data generated by the cookie, and relating to your use of the website (including your IP address), from being recorded and processed by Google by downloading and installing the browser plug-in from the following link: http://tools.google.com/dlpage....

We use Google Analytics to allow us to analyse and regularly make improvements to the operation of our website. The statistics gained enable us to improve our offer and to design the site in a more interesting way for you as the user. For the exceptional cases in which personal data is transferred to the USA, Google has undertaken to be subject to the EU-US Privacy Shield, www.privacyshield.gov/EU-US-Fr... .

The legal basis for using Google Analytics is provided by Article 6(1) sentence 1 point (f) of the GDPR.

USE OF SOCIAL MEDIA PLUG-INS

We currently use the following social media plug-ins: Facebook, Google+, Instagram, XING, Pinterest. For these, we use what is known as the “two click” solution. This means that when you visit our website, in principle no personal data is disclosed to the plug-in provider immediately. You can identify the provider of the plug-in by the marking on the box, by its initial letters or by its logo. We provide you with the option of using the button to communicate directly with the plug-in provider. Only when you click on the marked field and thereby activate it does the plug-in provider receive the information that you have visited the relevant website of our online presence. Furthermore, the data specified in § 3 of this statement is transferred. For Facebook and Xing, according to the information provided by the respective service providers in Germany, IP addresses are anonymised immediately after collection. When the plug-in is activated, personal data is transmitted from you to the relevant plug-in provider and stored there (in the USA in the case of USA service providers). As the plug-in providers use cookies in particular to collect data, if you do not wish this to occur we recommend that you delete all cookies via your browser’s security settings before you click on the greyed-out boxes.

We have no influence on the data that is collected and the data processing procedures, nor do we have knowledge of the full scope of the data collection, the purposes of the processing or the storage periods. We also have no information on deletion of the collected data by the plug-in providers.

The plug-in provider stores the data collected about you as user profiles and employs these for the purposes of advertising, market research and/or to customise their website to user needs. Analysis of this kind is carried out (including for users who are not logged in) to display tailored advertising in particular and to inform other users of the social network about your activities on our website. You have the right to lodge an objection to the creation of these user profiles; you must contact the relevant plug-in provider to exercise this right. We offer you the option to interact via these plug-ins with social networks and other users to improve our offering and to make it more interesting for you as a user. The legal basis for the use of plug-ins is Article 6(1) sentence 1 point (f) of the GDPR.

This transfer of data occurs irrespective of whether you have an account with the plug-in provider or are logged in with them. If you are logged in with the plug-in provider, your data that is collected on our site will be directly assigned to your account with the plug-in provider. When you click an activated button and share the page link, for example, the plug-in provider also stores this information in your user account and publicly notifies it to your contacts. We recommend that you log out regularly after using a social network, especially before activating the button, if you wish to avoid this type of assignment to your profile with the plug-in provider.

You can obtain more information on the purpose and scope of the data collection and processing by the plug-in providers in the data privacy statements provided below from these providers. You can also obtain further information there on your rights in this regard, and about the options for adjusting your settings to protect your privacy.

EMBEDDING OF YOUTUBE VIDEOS

We have embedded YouTube videos into our online presence. These are stored at http://www.YouTube.com and can be played directly on our website. These videos are all embedded using “extended data protection mode”, i.e. no data about you as a user will be transmitted to YouTube if you do not play the videos. Only when you play the videos will the data specified in § 2 be transferred. We have no influence on this data transmission.

When you visit the website, YouTube receives the information that you have called up the relevant sub-page of our website. Furthermore, the data specified in § 3 of this statement will be transferred. This happens irrespective of whether YouTube provides a user account, into which you are logged in, or whether no user account exists for you. If you are logged in to Google, your data will be directly assigned to your account. If you do not wish it to be assigned to your profile at YouTube, you must log out before you activate the button. YouTube stores your data as user profiles and uses these for the purposes of advertising, market research and/or customising the design of their website to match user needs. Analysis of this kind is carried out (including for users who are not logged in) to display tailored advertising in particular and to inform other users of the social network about your activities on our website. You have the right to lodge an objection to the creation of these user profiles; you must contact YouTube to exercise this right.

You can obtain further information on the purpose and scope of the data collection and processing by YouTube via their privacy policy. You can also obtain further information there on your rights in this regard, and about the options for adjusting your settings to protect your privacy: https://www.google.de/intl/de/policies/privacy. Google also processes your personal information in the USA and has undertaken to be subject to the EU-US Privacy Shield: https://www.privacyshield.gov/....

EMBEDDING OF GOOGLE MAPS

We use the Google Maps service on this website. This allows us to display interactive maps for you directly on the website and provides you with easy-to-use map functionality.

When you visit the website, Google receives the information that you have called up the relevant sub-page of our website, and the data specified in § 3 of this statement is transferred. This happens irrespective of whether Google provides a user account, on which you are logged in, or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not wish it to be assigned to your profile at Google, you must log out before you activate the button. Google stores your data as user profiles and uses these for the purposes of advertising, market research and/or customising the design of their website to match user needs. Analysis of this kind is carried out (including for users who are not logged in) to display tailored advertising in particular and to inform other users of the social network about your activities on our website. You have the right to lodge an objection to the creation of these user profiles; you must contact Google to exercise this right.

You can obtain further information on the purpose and scope of the data collection and processing by the plug-in provider in their privacy policy.

USE OF GOOGLE ADSENSE

This website uses the online advertising service Google AdSense, which allows advertising tailored to your interests to be displayed to you. We do this in the interests of showing you advertising that could be of interest to you, so as to make our website more interesting for you. To do this, statistical information on you is gathered, and this is processed by our advertising partner. These advertisements can be identified by the note “Google-Ads” in each advertisement.

When you visit our website Google receives the information that you have accessed our website. For this, Google uses a web beacon to place a cookie on your computer. The data detailed in § 3 of this document will be transferred. We have no influence on the data that is collected, nor do we have knowledge of the full scope of the data collection or the storage periods. We also have no information on deletion of the collected data by the plug-in providers. You data will be transferred to the USA and processed there. If you are logged in with your Google account, you data may be directly assigned to this account. If you do not wish this assignment to your Google profile to occur, you must log out. It is possible that this data may be transferred to contractors for Google, to third parties and officials.

The legal basis for the processing of your data is Article 6 (1) sentence 1 point (f) of the GDPR. This website does not activate any advertisements from third party suppliers via Google AdSense. Data as detailed above may be transferred to these third party suppliers (named at https://support.google.com/dfp_sb/answer/94149).

You can prevent the installation of Google AdSense cookies by various methods: a) by configuring your browser software appropriately; specifically, blocking of third party cookies will ensure that you do not receive any third party advertising; b) by de-activating interest-based advertising with Google via the link http://www.google.de/ads/preferences, although this setting will be lost if you delete your cookies; c) by de-activating interest-based advertising from providers which are part of the self-regulation campaign “About Ads”, via the link http://www.aboutads.info/choices, although this setting will be lost if you delete your cookies; d) by permanent deactivation in your Firefox, Internet Explorer or Google Chrome browser using this link: http://www.google.com/settings/ads/plugin. We draw your attention to the fact, however, that you may not be able to use all the functions of this website to their fullest extent if you do this.

You can obtain further information on the purpose and scope of the data collection and processing, and further information on your rights in this regard, and about the options for adjusting your settings to protect your privacy at: Google Inc., 1600 Amphitheater Parkway, Mountainview, California 94043, USA; Data protection terms and conditions for advertising: http://www.google.de/intl/de/policies/technologies/ads. Google has undertaken to be subject to the EU-US Privacy Shield: https://www.privacyshield.gov/....

USE OF GOOGLE ADWORDS CONVERSION

We use the services of Google Adwords to draw attention to our attractive offers on external websites by using advertising messages (known as Google Adwords). We may use the data from these advertising campaigns to measure how successful the individual promotional measures are. Our purpose in this is to show you advertising that is of interest to you, to make our website more interesting for you, and to ensure fair calculation of advertising costs.

These advertising messages are provided by Google using what is known as ‘Ad Servers’. For this we use Ad Server cookies, using which we are able to measure particular parameters of advertising success, such as advert views and user clicks. If you come across a Google advert on our website a cookie will be saved on your computer by Google Adwords. These cookies will in general lose their validity after 30 days and should then no longer serve to identify you personally. Data typically stored on these cookies for analysis purposes will be the unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions) and opt-out information (a flag if the user does not wish to be contacted again).

These cookies allow Google to recognise your web browser. If a user visits a particular page of the website of an Adwords customer and the cookie stored on their computer has not expired, Google and their customer can recognise that the user has clicked on the advertisement and been directed to this page. Each Adwords customer is assigned a different cookie. Cookies can not therefore be traced via the web pages of Adwords customers. We ourselves do not collect or process any personal data in the advertising process detailed above. From Google we receive only the statistical analysis which they make available. Using this analysis we can determine which of the advertising measures we use are particularly effective. We do not receive any additional data from the use of this advertising, and in particular we cannot identify the user on the basis of this information.

Because of the marketing tools used, your browser will automatically establish a direct connection with the Google server. We have no influence on the scope or subsequent processing of the data which is collected by Google through the use of these tools, and we can only inform you according to the extent of our knowledge: that though integration of AdWords Conversion, Google receives the information that you have accessed the relevant part of our web presence, or that you have clicked one of our advertisements. If you are registered with a Google service, Google can assign this visit to your account. Even if you are not registered with Google and/or have not logged in, there is still the possibility that the provider will note and save your IP address.

You can prevent your participation in this tracking activity by various methods: a) by configuring your browser software appropriately; specifically, blocking of third party cookies will ensure that you do not receive any third party advertising; b) by deactivating cookies for conversion tracking, by setting your browser to block cookies from the domain ‘www.googleadservices.com’; c) by de-activating interest-based advertising from providers which are part of the self-regulation campaign “About Ads”, via the link http://www.aboutads.info/choices, although this setting will be lost if you delete your cookies; d) by permanent deactivation in your Firefox, Internet Explorer or Google Chrome browser using this link: http://www.google.com/settings/ads/plugin. We draw your attention to the fact, however, that you may not be able to use all the functions of this website to their fullest extent if you do this.

The legal basis for the processing of your data is Article 6 (1) sentence 1 point (f) of the GDPR. Further information on Google data protection is available here: http://www.google.com/intl/de/... and at https://services.google.com/sitestats/de.html. Alternatively, you can visit the website of the Network Advertising Initiative (NAI) at http://www.networkadvertising..... Google has undertaken to be subject to the EU-US Privacy Shield: https://www.privacyshield.gov/....

REMARKETING

Alongside Adwords Conversion, we use the Google Remarketing service. This is a process through which we would like to appeal to you again. With this service, after your visit to our website our advertising may appear in your further internet use. This is managed through cookies saved in your browser via which your user behaviour in visiting different websites is collected and analysed by Google. This allows Google to recognise your previous visit to our website. According to Google’s statements there is no linking by Google of data collected as part of the Remarketing service with any of your personal data which may have been stored by Google. Specifically, according to Google a ‘pseudonymising’ process is applied for Remarketing.

FACEBOOK CUSTOM AUDIENCES

Furthermore, this website uses the “Custom Audiences” remarketing function from Facebook Inc. (“Facebook”). Through this, users of the website may, when they visit the social network site Facebook, or other sites using this service, be displayed interest-based advertising (“Facebook Ads”). Our purpose in this is to show you advertising which is of interest to you, and to make our website more interesting for you to use.

Because of the marketing tools used, your browser will automatically establish a direct connection with the Facebook server. We have no influence on the scope or subsequent processing of the data which is collected by Facebook through the use of these tools, and we can only inform you according to the extent of our knowledge: that though integration of Facebook Custom Audiences, Facebook receives the information that you have accessed the relevant part of our web presence, or that you have clicked one of our advertisements. If you are registered with a Facebook service, Facebook can assign this visit to your account. Even if you are not registered with Facebook and/or have not logged in, there is still the possibility that the provider will note and save your IP address.

Deactivation of the “Facebook Custom Audiences” function is available for logged-in users at: https://www.facebook.com/setti....

The legal basis for the processing of your data is Article 6 (1) sentence 1 point (f) of the GDPR. Further information on Facebook data protection is available here: https://www.facebook.com/about....
